Fracking Robs Owners of Land

•Oil and gas companies are exempt from the Safe Water Drinking Act. (It wasn’t always that way—thank the 2005 Energy Policy Act, passed under Bush and now known as the Halliburton Loophole.)
•Waste related to oil and gas exploration and production is exempt from the Resource Conservation and Recovery Act. (So there are no regulations on its disposal, meaning it can be handled in any way a company pleases, from being injected into the ground—regardless of its proximity to water supplies, animal habitats, etc.—to just being left on the land.)
•Because of loopholes in the Clean Air Act, oil and gas wells are not subject to restrictions on hazardous air pollutants. Garfield County, Colorado, for example, a site where a lot of fracking has taken place, has shown elevated levels of several hazardous air pollutants. Continue reading

The Lessons of BP Apply to Fracking

In states like New Mexico and Colorado, hydrofracking is contaminating the drinking water. The film, Gasland, shows numerous cases of homeowners who sold drilling rights to their land only to find that after the drilling their water became unusable — harming their own living circumstances and totally trashing future land values. Some households displayed black or brownish water from their taps, a few demonstrated that the water contained so much benzene that the homeowner was able to ignite the water as it came out of the tap.

Despite these safeguards, the oil and gas industries successfully lobbied Congress during the Bush administration for exemptions for hydrofracking. (As it happens, hydrofracking is a process used profitably by Halliburton where former vice president Dick Cheney was once CEO.) Hydrofracking was established as permissible with no need to comply with federal environmental safeguards. As a result, Americans must rely on state regulations.

Award-Winning HBO Doc Examines CO Fracking

Everyone was a film critic Monday at a somewhat tense screening of the new anti-gas-drilling documentary “Split Estate” for the Garfield County commissioners. Most of the reviews — surprisingly, even from the industry — were glowing.

“Split Estate,” an award-winning documentary detailing the environmental conflicts between surface property owners and mineral-rights holders allowed to extract natural gas from their land, was screened for the commissioners at the request of the Grand Valley Citizens Alliance, which hopes to get a resolution from the board supporting greater federal oversight.
